Environmental Liability Act
On 22 April 200,8 Act No. 167/2008, on Prevention and Remedying Environmental Damage and Amendment to Some Laws was published in the Collection of Laws.
This act processes the relevant European Community regulation and regulates the persons’ rights and duties in the prevention of environmental damage and its remedy, if this has incurred or is imminent to protected species of wild fauna and flora, the natural habitats, as defined by this act, and to water or soil.
The act relates for example to the following operating activities:

Installations operated subject to issuance of the integrated permit

Installations operated for waste utilisation, removal, collection or repurchase

Wastewater discharge into surface or groundwater on the basis of a special legal regulation

Pumping of polluted groundwater and its subsequent draining into surface water or groundwater on the basis of a special legal regulation

Surface water draw-of on the basis of a special legal regulation

Groundwater draw-of on the basis of a special legal regulation

Swell or accumulation of surface water on the basis of a special legal regulation

Handling harmful substances on the basis of Section 39 paragraphs 2 and 4 of Act No. 254/2001 Coll., as amended

Dangerous chemical substances and chemical preparations management, plant protection products or biocidal products management on the basis of Section 44a of Act No. 258/2000 Coll., as amended

Operating stationary air pollution sources subject to a permission on the basis of Act No. 86/2002 Coll., as amended
